American Resurfacing Inc (“us,” “we,” or “our”) is committed to respecting the intellectual property rights of others. We take claims of copyright infringement and the unauthorized use of content very seriously. This “Notice and Take Down” policy outlines the procedure to follow if you believe that your copyright or other intellectual property rights have been infringed upon through our website.

  1. Reporting Copyright Infringement

If you are the owner of copyrighted material and believe that your rights have been infringed, please provide us with the following information in writing:

  • A description of the copyrighted work that you claim has been infringed.
  • Identification of the specific location on our website where the infringing material is found.

  1. Action Upon Receiving a Valid Notice

Upon receiving a valid notice of copyright infringement or a properly substantiated intellectual property infringement claim, we will:

  • Promptly remove or disable access to the infringing material.
  • Notify the alleged infringer of the claim and the removal or disabling of the material.
  • Provide the alleged infringer with your contact information, enabling them to respond or seek legal action if they believe their content was wrongly removed.
  1. Counter-Notification

If you believe that your content was wrongly removed due to a mistake or a misidentification, you may file a counter-notification. Your counter-notification should include:

  • Identification of the material that was removed and its location on the website.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your contact information, including your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if you are located outside the United States, to the jurisdiction of the U.S. District Court for the District of North Dakota, and that you will accept service of process from the person who provided the original copyright infringement notification.

American Resurfacing Inc may terminate the accounts of users who are determined to be repeat infringers of intellectual property rights.
